Understanding Employment Law Issues

Weisberg Cummings, P.C. handles a number of common labor issues, including:

  • Discrimination. Discrimination due to sex, race, ethnic background, religion and country of origin is illegal. In parts of Pennsylvania, discrimination against someone because of their sexual orientation is also illegal. In many cases, discrimination is very subtle. It may take the form of wage gaps, harassment or failure to promote or hire. Often, it takes a skilled employment law attorney to prove cases of discrimination.
  • Employer retaliation. Whistleblower laws are in place for a reason. If you have been passed over for promotions, given bad reviews, fired or demoted after complaining about unsafe working conditions, harassment or illegal company policies at your workplace, you do have rights. You can fight back through a legal claim.
  • Work accidents. Workplace accidents can result in months or even a lifetime of pain as well as high medical bills and lost wages. Insurance may protect workers from financial losses following an on-the-job injury, but often injured workers have to collaborate with attorneys to get the fair workers’ compensation they deserve.
  • Contracts. Employment contract disputes can last for months and can affect an organization’s productivity, reputation and profitability.   • FMLA. The Family and Medical Leave Act (FMLA) is meant to offer unpaid leave to workers who have a qualified family or medical emergency. FMLA leave is supposed to protect the worker’s job, and if employers fire a worker on this type of protected leave, employees may be able to pursue a legal claim.
  • Sexual Harassment. Inappropriate sexual advances, sexualized comments, abuse, threats or sexual coercion can all be classified as sexual harassment. In many cases, employees are able to fight back by working with a labor law attorney.
  • ADA. The Americans with Disabilities Act (ADA) is meant to protect qualified workers with a disability from harassment and discrimination. Unfortunately, some employers are still not welcoming or accepting of disabled workers in the workplace. When this happens, a qualified employment law attorney can pursue a claim and compensation on behalf of the employee.
  • Class Action Lawsuits. In many cases, labor law claims involve an individual employee and the company. However, in some cases where employers discriminate against groups of people or provide an unsafe workplace, class-action lawsuits may be used to allow groups of employees with a similar complaint to file a claim together.
